VIOXX SETTLEMENT

Merck is considering a Vioxx settlement because of the numbers of people that are making claims against them. It doesn’t mean that they are responsible for the medical mishaps of the people, but they feel it would be cheaper than fighting each case one by one.

Merck should fight each case one by one because they are winning due to the people who do have claims. Most people are looking to blame someone else for their medical mishap when their obesity, diabetes, alcohol consumption, ulcer, and other medical conditions were what was really to blame for the problem. They are winning most of the cases. 91 million people in the United States alone were taking the prescription drug Vioxx and less than 1% of the people are coming forward now that they have heard there might be money involved.

Although Merck is winning the lawsuits being brought to them one at a time, it still cost a lot of money to go through a lawsuit. The people suing them are having to pay their own court attorney fees, but Merck is having to fight one person at a time. The costs are overwhelming for the company. The company is considering a Vioxx settlement for a class action suit so they can just get the people to go away. All they are really looking for is money. Financially, it is easier for Merck to fork out 500 million of the 50 billion dollars that they made from the sales of the drug. That isn’t even a full percentage of their earnings and it won’t phase the company.

Proper company damage control would say that Merck should not have a Vioxx settlement and they should fight every single case that comes their way. This will eliminate half of the people just looking for money and they will drop their claims prior to getting to the courtroom. This will allow Merck to save their reputation as a prescription drug company and not to have to worry about any future claims.
